Selecting a property solicitor

Your home move can be a thousand times less stressful if you use a good legal company. Contracts and legal work are one of the most common reasons for moving delays and timing is everything when there's a chain involved. If you are selling a property it's a good idea to get a HIP (home information pack) quote at the same time.

You don't have to use a company in your area - compare legal fees and service online and get the best deal you can from a recommended company. Make sure you choose a legal company that gives a fixed fee and offers no sale no fee purchase so if your sale and purchase falls through, you don't have to pay for the conveyor's time.

Find out if the company will email or fax documents over to you to speed the process up. Waiting for the post can delay the simplest of queries by several days.

Things to remember

As soon as a prospective purchaser wishes to bid for a property they should contact their solicitor immediately to note interest with the selling agent and prepare a written offer. Before offering for a property ensure that you have been approved in principle for a mortgage or you have an alternative source of funds.

If you are dependent on the funds from the sale of an existing property to help fund the purchase of another property ensure you have a binding contract for the sale first.

Moving in Scotland

There are two parts to the purchase and sale of Scottish Property: The "Missives" which are the binding contract signed by your solicitors on your behalf and "Settlement" which is the contractual date when the price is paid over in exchange for entry to the property and delivery of the signed title deeds.

From 1/12/2008 most sellers in Scotland must obtain a Home Report before marketing their property for sale and from 4/1/2009 all Scottish properties sold must have an Energy Performance Certificate.

It is important that you discuss these matters in detail with your solicitor before committing to buy or sell a house.
